1. Introduction
Welcome to Golden Estate Investments. These Terms & Conditions govern the use of our services for investors, landlords, and tenants. By accessing our services, you agree to comply with and be bound by the terms set out below. If you do not agree with any part of these terms, please do not use our services.
2. Definitions
"Company" refers to Golden Estate Investments, including its employees, agents, and affiliates.
"Investor" refers to any person or entity seeking property investment opportunities.
"Landlord" refers to property owners seeking management or rent-to-rent services.
"Tenant" refers to individuals leasing properties through our services.
"Services" refers to property sourcing, management, and investment opportunities provided by the Company.
3. Responsibilities
3.1 Responsibilities of Investors:
Provide accurate financial and personal information.
Conduct independent due diligence before making any investment decisions.
Comply with applicable legal and regulatory requirements, including compliance with the Financial Services and Markets Act 2000.
3.2 Responsibilities of Landlords:
Provide properties in a habitable and legally compliant condition in accordance with the Housing Act 2004.
Ensure full disclosure of property conditions and legal ownership.
Cooperate with the Company in resolving maintenance and tenant-related issues.
Comply with the Landlord and Tenant Act 1985 regarding repair obligations.
3.3 Responsibilities of Tenants:
Pay rent and utility bills on time.
Maintain the property in good condition.
Abide by the terms of the tenancy agreement, including responsibilities outlined in the Tenant Fees Act 2019.
Notify the landlord or management of any necessary repairs.
4. Payment Terms
Investors and landlords must make payments as per the agreed contract.
Any late payments may incur penalties or interest as specified in the agreement.
Refunds, where applicable, will be processed in accordance with our Refund Policy (see Section 7).
Payments will be processed securely in compliance with the Payment Services Regulations 2017.
5. Dispute Resolution
Any disputes arising under these Terms & Conditions shall first be attempted to be resolved amicably.
If no resolution is achieved, disputes shall be referred to an independent mediation service accredited by the Civil Mediation Council.
The governing law for dispute resolution shall be the laws of England and Wales.
6. Limitation of Liability
The Company shall not be held liable for any direct, indirect, or consequential losses arising from the use of our services.
We do not guarantee investment returns or tenant occupancy.
The Company shall not be responsible for any third-party services recommended.
Nothing in this clause shall exclude liability for personal injury or death caused by negligence.
7. Refund Policy
Investors may request refunds within 14 days of payment if no service has been delivered, in compliance with the Consumer Contracts Regulations 2013.
Landlords are eligible for refunds if services are not provided as agreed in the management contract.
Tenants may request refunds of deposits subject to compliance with tenancy agreements and inspection of the property.
All refunds will be processed within 30 days.
8. Termination
The Company reserves the right to terminate agreements if there is a material breach of these Terms & Conditions.
Termination notice periods will be specified in individual contracts.
Any fees paid prior to termination are non-refundable unless otherwise agreed.
In the event of a force majeure event, obligations may be suspended or terminated without liability.
9. Privacy Policy
We collect and process personal data in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR).
By using our services, you consent to the collection and use of your data as outlined in our Privacy Policy.
10. Amendments
The Company reserves the right to modify these Terms & Conditions at any time.
Changes will be effective upon posting on our website and shall be notified to users via email at least 30 days before the changes take effect.
11. Indemnity
Users agree to indemnify and hold the Company harmless from any claims, liabilities, damages, and expenses arising out of misuse of our services or breach of these terms.
12. Notices & Communications
By using our services, you consent to receiving communications electronically via email or our website.
